Introduction

Welcome to CineRevs© (“we”, “our”, “us”). These Terms and Conditions (“Agreement”) govern your use of our real estate and corporate photography/videography services. By hiring us or using our services, you agree to comply with and be bound by the following terms. If you do not agree with these terms, please refrain from using our services.

1. Services

We provide professional real estate and commercial photography/videography services within London and it’s surrounding areas, including but not limited to property photoshoots, virtual tours, floor plans, aerial (drone) photography/videography and video walkthroughs.

2. Booking & Payments
  • Booking: A non-refundable booking fee of £50.00 is required via our online booking system, followed by 50% of the total project cost to confirm your booking.
  • Payment: Once 50% of the total project cost has been received, a second invoice will be issued for the remaining 50%, which will be due 7 days prior to the scheduled filming date.  If a booking is made 7 days or less prior to shoot, then full payment will be requested upon booking.  We accept payments via PayPal or Direct Debit.
  • Late Payments: Late payments will incur a late fee of 8% per day of the total service cost after the due date.
  • Cancellation & Rescheduling: Cancellations or rescheduling must be made at least 48hrs before the scheduled shoot. Late cancellations (within 48hrs of the shoot) will result in a cancellation fee of 50% of the total booking cost.
  • Travel Expenses: Travel expenses within London and it’s surrounding areas will be included in our service plan costs.  If our services are requested outside of these areas you may incur additional travel costs.
3. Deliverables
  • Turnaround Time: Edited photographs and videos will be delivered within 4-5 business working days of the shoot, unless agreed otherwise.
  • File Delivery: We will deliver the final high-resolution digital files via a cloud storage link.
  • Revisions: One round of revisions is included in the service price. Additional revisions will incur a fee of £60 per hour per revision.
4. Copyright and Usage Rights
  • Ownership: All photographs and videos are copyrighted by CineRevs©. We retain full ownership of all intellectual property unless a specific rights agreement is made in writing.
  • License to Client: Upon full payment, we grant you a non-exclusive, perpetual license to use the images/videos for marketing, promotional, and personal use related to your business/property. This license does not allow for resale, distribution, or commercial exploitation of the content without our prior consent.
  • Portfolio Usage: We reserve the right to use any images or videos from your project for our own marketing, portfolio, and promotional purposes unless otherwise agreed in writing.
5. Client Responsibilities
  • Access to Property/Location: It is the client’s responsibility to ensure that access to the property or location is available at the agreed time. Delays caused by access issues may result in additional charges.
  • Preparation: The client is responsible for preparing the property or space (e.g., cleaning, staging) prior to the shoot. Any delays or extra work required due to lack of preparation may incur additional costs.
  • Permissions: The client is responsible for obtaining any necessary permissions, clearances, or consents to photograph or film the property or individuals. This includes securing any necessary third-party releases (e.g., for drone use).
6. Drone Photography/Videography (if applicable)
  • Legal Compliance: Our drone services comply with all relevant UK regulations, including obtaining necessary permissions from the Civil Aviation Authority (CAA).
  • Restrictions: Drone flights are weather and location-dependent. We reserve the right to cancel or postpone drone operations if conditions are unsafe or legally restricted. In such cases, we will endeavour to reschedule or offer a refund for the drone services portion of the booking.
7. Liability
  • Limitation of Liability: We are not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our liability for any direct damages is limited to the total fees paid for the specific service.
  • Damage to Property: While we take care to avoid any damage to the client’s property during shoots, we are not responsible for accidental damage unless caused by negligence or wilful misconduct.
  • Client Satisfaction: In the event that the client is dissatisfied with the work provided, we must be notified in writing within 7 days of delivery. Any issues will be addressed and rectified where possible.
8. Force Majeure

We are not liable for any failure to provide services due to events beyond our control, including but not limited to natural disasters, government restrictions, pandemics, strikes, or equipment failure. In the event of such circumstances, we will work with you to reschedule the shoot as soon as possible.

9. Privacy and Data Protection

We are committed to protecting your privacy in accordance with the General Data Protection Regulation (GDPR). Any personal data collected during the course of our services will only be used to fulfil your booking and provide you with relevant updates or promotions related to our services. We do not share your information with third parties without your consent.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Amendments

We reserve the right to amend these Terms and Conditions at any time without prior notice. Any changes will be effective upon posting on our website or notification to you in writing.
